In an era characterized by fast technological progress that introduces new unpredictable scenarios every day, working in the law field may appear very difficult, if not supported by the right tools. In this respect, some systems based on Artificial Intelligence methods have been proposed in the literature, to support several tasks in the legal sector. Following this line of research, in this paper we propose a novel method, called PRILJ, that identifies paragraph regularities in legal case judgments, to support legal (...) experts during the redaction of legal documents. Methodologically, PRILJ adopts a two-step approach that first groups documents into clusters, according to their semantic content, and then identifies regularities in the paragraphs for each cluster. Embedding-based methods are adopted to properly represent documents and paragraphs into a semantic numerical feature space, and an Approximated Nearest Neighbor Search method is adopted to efficiently retrieve the most similar paragraphs with respect to the paragraphs of a document under preparation. Our extensive experimental evaluation, performed on a real-world dataset provided by EUR-Lex, proves the effectiveness and the efficiency of the proposed method. In particular, its ability of modeling different topics of legal documents, as well as of capturing the semantics of the textual content, appear very beneficial for the considered task, and make PRILJ very robust to the possible presence of noise in the data. Diatoms are important protists that generate one fifth of the oxygen produced annually on earth. These aquatic organisms likely derived from a secondary endosymbiosis event, and they display peculiar genomic and structural features that reflect their chimeric origin. Diatoms were one of the first models of cell division and these early studies revealed a range of interesting features including a unique acentriolar microtubule‐organising centre. Unfortunately, almost nothing is known at the molecular level, in contrast to the advances in other experimental (...) organisms. Recently the full genome sequences of two diatoms have been annotated and molecular tools have been developed. These resources offer new possibilities to re‐investigate the mechanisms of cell division in diatoms by recruiting information from more intensively studied organisms. A renaissance of the topic is further justified by the current interest in diatoms as a source of biofuels and for understanding massive diatom proliferation events in response to environmental stimuli. This article aims to analyze how the so-called ‘pedagogy of work’ attempts to answer the challenges of unemployment and job insecurity characterizing the labor market in contemporary society. The authors reflect on the concepts of nihilist pedagogies and the ‘end of work’ by distinguishing two approaches: an active and a passive nihilist pedagogy. The passive approach, based on resignation, is opposed to an active attitude in which labor pedagogy offers tools to address current challenges. The authors support the idea that (...) pedagogy as a human-improving science cannot adopt the position of passive nihilism in interpreting work in contemporary society. To better understand the dynamics related to job insecurity and corrective solutions by pedagogy, the authors analyzed the thoughts of three contemporary philosophers: Zygmunt Bauman, Jeremy Rifkin, and Dominique Méda. These authors redefined the concept of work in connection with the transformations because of globalization, the advent of new communication technologies, and digital work. These changes have redefined not only the concept of work but also the models of work pedagogy in the Western world: capitalism and Marxism. Considering the current challenges, the pedagogy of work needs to be rethought, starting from the problem of employability and focusing on the new occupations in demand in the Internet age. By integrating ideas on interpreting work from the theories of Bauman, Rifkin, and Méda, it is possible to propose a pedagogy of work in the age of change and to outline possible values of education inspired by it. This paper distinguishes the respective aims of Jaspers's and Heidegger's philosophical enterprises with reference to their radically divergent uses of the key terms. It was always been of the essence of Jasper's concept of philosophy that it « appropriate » tradition and validate its own possibilities in « differentiation » from tradition. Accordingly Heidegger is not concerned, as is Jaspers, over the « gold » of the « perennial philosophy » but, against the background of the « question of Being (...) » , over the « destruction » of Western philosophy as such. Jaspers's philosophy attempts to save philosophy in the 20th century in the face of Heideggers's destruction of the ontologicei heritage. Cet article distingue les buts respectifs de Jaspers et de Heidegger en référence à leurs usages divergents des termes clés. Il est de l'essence de la philosophie selon Jaspers de « s'approprier » la tradition et de mettre en évidence ses propres possibilités en se distinguant d'elle. Heidegger n'est pas concerné comine Jaspers par la philosophia perennis mais par la « question de l'être » , par la destruction de la philosophie occidentale. Jaspers tente de sauver la philosophie du XX e siècle face à la destruction par Heidegger de l'héritage ontologique. (shrink)

Parto de uma conceitualização geral de como o problema do mal fora abordado ao longo da tradição filosófica e religiosa, enquanto problema ontológico e relativo, no mais das vezes, a uma teodiceia que busca explicar a existência do mal no mundo. Em seguida, abordo uma nova forma de se pensar o problema do mal através do pensamento idealista de Immanuel Kant, que movimentou a problemática em uma direção outra àquela anterior, ou seja, afirmando que o mal não era um problema (...) localizado na realidade, mas no sujeito enquanto ser dotado de moralidade, residindo na dimensão mais radical da natureza humana. Em Arendt, o mal deixa o plano do sujeito singular e passa a ser compreendido enquanto um fenômeno político. Para a autora, o mal não deve ser um fenômeno político, todavia com a ascensão dos movimentos totalitários e outros fenômenos de ruptura com o fio da tradição, esse problema passa a ocupar a dimensão da vida pública. Desta forma, o objetivo da autora é tentar compreender as condições para se pensar o mal enquanto fenômeno político, assim como aquilo que lhe fundamenta e garante legitimidade. O fio condutor deste artigo são as obras Origens do Totalitarismo (ARENDT, 2018) e o conjunto de ensaios publicados no período de 1930-54 (ARENDT, 2008). O produto da presente análise refere-se à experiência humana da solidão enquanto fundamento do mal na esfera política. (shrink)

Business ethics, which grew out of religion's interest in ethics in business and management education's concern with social issues, has become an interdisciplinary academic field. Thus far it has centered on teaching undergraduates. The easy work has now been done and the field has reached a plateau. To develop further it requires development on the MBA level, high quality research on new questions, positive models, better interdisciplinary integration, and attention to international business. While $$\Lambda $$ Λ CDM has emerged as the standard model of cosmology, a small group of physicists defends modified newtonian dynamics (MOND) as an alternative view on cosmology. Exponents of MOND have employed a broad, at times explicitly philosophical, conceptual perspective in arguing their case. This paper offers reasons why that MONDian defense has been ineffective. First, we argue that the defense is ineffective according to Popperian or Lakatosian views–ostensibly the preferred philosophical views on theory assessment of proponents of (...) MOND. Second, we argue that the defense of MOND can instead best be reconstructed as an instance of meta-empirical theory assessment. The formal employment of meta-empirical assessment by MONDians is unconvincing, however, because it lacks a sufficient epistemic foundation. Specifically, the MONDian No Alternatives Argument relies on falsifiability or explanation conditions that lack epistemic relevance, while the argument from Unexpected Explanatory Success fails since there is a known alternative to MOND. In the last part of the paper, we draw some lessons for applications of meta-empirical assessment more generally. (shrink)

Philosophers have constituted business ethics as a field by providing a systematic overview that interrelates its problems and concepts and that supplies the basis for building on attained results. Is there a properly theological task in business ethics? The religious/theological literature on business ethics falls into four classes: (1) the application of religious morality to business practices; (2) the use of encyclical teachings about capitalism; (3) the interpretation of business relations in agapa-istic terms; and (4) the critique of business from (...) a liberation theological point of view. Theologians have not adequately addressed the questions of whether there are particular theological tasks in the field as they define it, and whether, if they define it, the theological definition is different from the philosophical. It attempts to determine the ethical responsibility of the drug industry in making drugs available to the needy, while at the same time developing the parallel responsibilities of individuals, governments, and NGOs. Although I share many of the doubts about corporate citizenship of Néron and Norman, I join in their constructive project both by offering friendly criticism and by suggesting that their approach be extended further than they carry it. I argue first that rather than attempting to reform the language of corporate citizenship, we support its use where the effects are positive; second, that we concentrate on the fifth of their candidates for assessment; and third, that we extend the discussion to (...) consider what it means to be a good global citizen, and whether that is compatible with being a good citizen of a particular state.
